CG 20 33: Additional Insured, Owners, Lessees or Contractors, Automatic Status When Required in Construction Agreement With You

CG 20 33 is ISO's original blanket additional insured endorsement for construction. Instead of a schedule, it grants status automatically to any person or organization for whom the named insured performs operations when the two have agreed in writing that the party be added. That saves subcontractors from issuing a new endorsement for every job. The catch is privity: status reaches only the party that signed the agreement with the named insured, and it ends when operations for that party are completed. Owners, lenders and other upstream parties are left out unless another form reaches them.

The edition stamp in the endorsement footer identifies the exact wording. Pikorua Security reads it on every page and compares it with the editions your contract accepts.

CG 20 33 editions and what changed
EditionWhat changed
1997Introduced as ISO's automatic version of CG 20 10, so subcontractors would not need a scheduled endorsement for every general contractor. Status ended when operations for the additional insured were completed.
10 01Revised in the 2001 additional insured cycle that introduced CG 20 37 for completed operations. CG 20 33 itself stayed limited to ongoing work.
07 04"Arising out of" replaced with "caused, in whole or in part, by" the named insured's acts or omissions in the performance of ongoing operations for the additional insured. No coverage for the additional insured's sole negligence.
04 13Added the 2013 limiters (extent permitted by law, no broader than the agreement requires, limits capped at the lesser of the contract amount or Declarations limits). Trigger reads: you and the party "have agreed in writing in a contract or agreement."
12 19LatestTitle adds "Written" ("When Required in Written Construction Agreement With You"); limits cap refers to limits available rather than limits shown in the Declarations. Released alongside CG 20 39 12 19, the blanket completed operations companion for the same direct-contract parties.

CG 20 33 amends Who Is An Insured to include any person or organization for whom the named insured is performing operations when the named insured and that person or organization have agreed in writing, in a contract or agreement, that it be added as an additional insured. Coverage is limited to bodily injury, property damage and personal and advertising injury caused, in whole or in part, by the named insured's acts or omissions (or those acting on its behalf) in the performance of ongoing operations for that additional insured.

Status ends when the named insured's operations for that additional insured are completed, and the form carries the familiar completed operations exclusion: no coverage for injury occurring after all work on the project has been completed, or after the portion of work that caused the injury has been put to its intended use. The 04 13 and later editions add the standard limiters: coverage only to the extent permitted by law, no broader than the agreement requires, and limits capped at the lesser of the contract requirement or available limits.

For a general contractor, CG 20 33 on a subcontractor's policy usually works for the GC itself, because the GC signed the subcontract. It rarely works for the owner, because the owner did not.

How CG 20 33 behaves in a tender or claim

The tender analysis starts with paperwork. The carrier will ask for the written agreement between the named insured and the tendering party, check that it requires additional insured status, and look at when it was signed. A subcontract executed after the accident, or a purchase order whose terms never mention insurance, is a common reason for denial. Oral agreements and emailed scope letters without insurance terms do not trigger the form.

Privity disputes come next. Courts, including New York's highest court in a 2018 decision on similar blanket wording, have read language requiring a written agreement with the named insured to limit status to the named insured's direct contracting party. An owner named in the prime contract, but not a signatory to the subcontract, can be denied coverage even where the subcontract plainly required the sub to protect the owner. That gap is why ISO introduced CG 20 38 with the 2013 forms.

Then the timing of the injury. A fall during framing is ongoing operations. Water intrusion discovered after the owner occupies the building is completed operations and falls outside CG 20 33 entirely unless the sub also carries CG 20 37 or, on 2019 programs, the blanket CG 20 39.

Edition history

ISO introduced CG 20 33 in 1997 as an automatic version of CG 20 10, so subcontractors would not need a scheduled endorsement for every general contractor. From the start, status ended when operations for the additional insured were completed. The 2001 cycle, which introduced CG 20 37 for completed operations, left CG 20 33 limited to ongoing work.

The 07 04 edition replaced "arising out of" with "caused, in whole or in part, by," removing coverage for the additional insured's sole negligence. The 04 13 edition added the three limiters. The 12 19 edition inserts "Written" into the title, updates the limits cap to refer to limits available rather than limits shown in the Declarations, and arrived with CG 20 39, a blanket completed operations companion for the same direct-contract parties.

What to require or prohibit in the contract

Accept CG 20 33 for the direct contracting party only. If your prime contract obligates you to protect the owner, its lender, the architect or a construction manager, either require CG 20 38 (which reaches parties the sub must add under its contract with you) or require a scheduled CG 20 10 listing each of them. Pair either with completed operations coverage.

Write the subcontract so the insurance requirement is unmistakable: a signed agreement, executed before work starts, that expressly requires additional insured status for named parties and for any party the prime contract requires. Do not rely on a master agreement that was never countersigned, or on a purchase order whose terms and conditions sit on a website.

  • Require: CG 20 33 or CG 20 38 for ongoing operations, plus CG 20 37, CG 20 39 or CG 20 40 for completed operations, with the duration stated in years.
  • Require: an executed subcontract or work order before mobilization. Pikorua Security treats an unsigned agreement as no agreement.
  • Prohibit: carrier blanket wording limited to parties "with whom you have a direct written contract" when your prime contract requires upstream additional insureds.

How Pikorua Security verifies or flags CG 20 33

Pikorua Security recognizes CG 20 33 by its footer and grant language and records it as blanket status with a direct-contract trigger. It then compares the additional insureds your exhibit requires (pulled from the prime contract on the project record) against who the form actually reaches. When the exhibit names the owner or lender and the only form on file is CG 20 33, the file is flagged with a specific reason: "Owner not reached: blanket form requires a written agreement with the named insured."

The agreement check runs at the same time. Pikorua Security confirms an executed subcontract is attached to the vendor record in Procore or CMiC and that its signature date precedes mobilization. If the subcontract is still in draft, the vendor stays at the compliance gate, and pay applications can be held until the record is complete.

6 checks
  1. Flag 01

Owner or lender listed in the prime contract is not reached, because CG 20 33 requires a written agreement between the named insured and the additional insured.

  2. Flag 02

Subcontract signed after work began, or after the date of injury, leaving no qualifying written agreement at the time of loss.

  3. Flag 03

A purchase order or unsigned master agreement is the only document, with insurance terms incorporated by reference to a web page.

  4. Flag 04

No completed operations companion (CG 20 37 or CG 20 39), so coverage ends when the sub demobilizes.

  5. Flag 05

Certificate says "blanket additional insured per written contract" with no form number, and the attached endorsement is a carrier form with narrower wording.

  6. Flag 06

Limits cap reduces the additional insured's limit to whatever the subcontract states, even when the sub carries higher limits.

Insurance exhibit clause

CG 20 33: AI: blanket, direct contract

Additional Insured Status. Subcontractor shall cause Contractor, Owner, and every other person or organization Contractor is required to include as an additional insured under the Prime Contract (each listed in Schedule 1 to this Exhibit) to be included as additional insureds on Subcontractor's commercial general liability, umbrella and excess policies. For ongoing operations, coverage shall be provided by ISO CG 20 38 (04 13 or later), by ISO CG 20 10 scheduling each party, or by ISO CG 20 33 only where the endorsement reaches every party in Schedule 1. For completed operations, coverage shall be provided by ISO CG 20 37, CG 20 39 or CG 20 40, or equivalent wording, for not less than three (3) years after final completion of the Project. Subcontractor acknowledges that this Subcontract is the written agreement requiring such status, that it is executed before Subcontractor begins work, and that its requirements extend to each party in Schedule 1 whether or not that party signs this Subcontract.

Have counsel conform the clause to the governing law of your contract. Pikorua Security verifies insurance documents against the requirements you set; it does not provide legal advice and does not sell, bind or underwrite insurance.

When the claim arrives

Tender defensibility

A CG 20 33 tender by the party that signed the subcontract is usually straightforward if the signature predates the loss and the injury happened during ongoing operations. Tenders by owners and other upstream parties are the weak point: expect the carrier to cite the written agreement requirement and deny status. The time to fix that is at onboarding, by requiring CG 20 38 or a scheduled endorsement. When Pikorua Security has verified the reach of the form against the prime contract list before work starts, the tender packet contains the executed subcontract, the issued endorsement, and a record showing each required party was confirmed as reached on a specific date.

Frequently asked questions

What is the difference between CG 20 33 and CG 20 38?
Both are blanket forms limited to ongoing operations. CG 20 33 reaches only the party that agreed in writing with the named insured. CG 20 38, introduced with the 04 13 editions, also reaches any other party the named insured is required to add under that same agreement, such as the owner named in a general contractor's subcontract.
Does CG 20 33 cover completed operations?
No. Status ends when operations for the additional insured are completed, and a completed operations exclusion applies. Pair it with CG 20 37 or, on 12 19 programs, the blanket CG 20 39.
Does an email or verbal agreement satisfy CG 20 33?
No. The form requires that the parties have agreed in writing in a contract or agreement, and carriers look for that agreement to be in place before the injury. A signed subcontract or work order with explicit additional insured terms is the safe standard.
Can I accept a carrier's own blanket form instead of CG 20 33?
Yes, if the wording is at least as broad. Read the trigger closely: phrases like "with whom you have agreed in a written contract" raise the same privity issue, and some carrier forms add conditions such as requiring the agreement to be executed before the injury. Pikorua Security compares carrier wording clause by clause against the ISO baseline your exhibit names.
