Excavation & Sitework subcontractors

Excavation & Sitework subcontractor COI requirements

Excavation subs work under the ground other people depend on: utilities, adjacent foundations, railroad property and contaminated soil. Their policies are where carriers attach explosion, collapse and underground exclusions, subsidence wording and total pollution exclusions. A clean certificate from an excavator often hides an XCU exclusion that removes the exposure the GC hired them to manage.

Endorsement checklist

Forms to see attached, not just checked

A Y in the ADDL INSD column is not an endorsement. Ask for each form below by number and edition, and read the excavation sub's schedule of forms against it.

Exclusion watchlist

Exclusions that void excavation coverage

These never appear on an ACORD 25. They sit in the declarations schedule of forms and the endorsement pages, which is where Pikorua Security reads.
  • Red flag

Explosion, collapse and underground (XCU) exclusion

ISO removed XCU exclusions from the standard CGL in 1986, but many carriers still attach their own XCU endorsements to excavators. Underground resources damage (striking a gas main or fiber line) and collapse of adjacent structures from undermining are the very losses this exclusion removes.

  • Red flag

    Subsidence or earth movement exclusion

Excludes damage arising from settling, sinking or shifting of land. Excavation and dewatering are a direct cause of neighboring settlement, so this exclusion can leave the GC alone against an adjacent owner's claim.

  • Red flag

Total pollution exclusion (CG 21 49)

Removes even the limited carve-back for fuel and lubricant releases from mobile equipment. Excavators run fleets of diesel equipment over open soil every day.

  • Red flag

Railroad exception in the insured contract definition

The standard CGL insured contract definition does not cover contractual liability for construction or demolition within 50 feet of railroad property. Without CG 24 17 scheduling the railroad and job site, the indemnity the railroad demands is uninsured.

XCU: the exclusion a certificate never shows

Explosion, collapse and underground property damage were excluded from contractors' liability policies until ISO dropped the XCU exclusions from the standard form in 1986. Carriers did not stop caring about the exposure; many write excavators with their own XCU endorsements. The certificate shows $1,000,000 and $2,000,000. The endorsement schedule shows a form that excludes damage to underground utilities and collapse caused by excavation.

Pikorua Security's excavation template reads the schedule of forms and flags any explosion, collapse, underground or subsidence wording by title and form number. When the carrier uses a manuscript form, the OCR pass reads the endorsement text and matches the exclusionary language rather than relying on a known form list.

Pollution, spoils and contaminated ground

Sitework disturbs whatever is in the ground. Urban infill, former industrial sites and brownfield redevelopment regularly turn up contaminated soil, and the excavator is the contractor who moves it. Fuel releases from equipment are a daily exposure, and transporting spoils off site adds a transportation pollution risk the CGL does not cover.

  • Require contractors pollution liability with transportation coverage when the sub hauls spoils.
  • Ask whether the CPL is occurrence or claims-made, and check the retroactive date.
  • Name the GC and owner as additional insureds on the CPL, not just the CGL.

Railroads, utilities and adjacent property

Work on or within 50 feet of railroad property brings two separate requirements. The railroad will usually require a railroad protective liability policy (ISO CG 00 35) issued in its own name, and it will require the contractor's CGL to carry CG 24 17 so the contractual liability assumed in the right-of-entry agreement is insured. Railroads and transit agencies often name the edition, such as CG 24 17 10 01.

Before mobilization, Pikorua Security checks the project flags you set (railroad adjacency, utility density, adjacent structures) and adds the matching rules to the excavation template, so the deficiency notice to the sub's broker lists exactly what the railroad agreement demands.

How to verify an excavation sub's COI

A manual review of one COI and its endorsement packet takes 25 to 40 min (CFMA Time Study). These are the six checks, in the order Pikorua Security runs them.

  1. 1

Match the named insured to the subcontract

Compare the named insured on the ACORD 25 with the legal entity that signed the excavation subcontract, including the LLC or Inc. suffix. A trade name or DBA is not the contracting entity, and additional insured coverage follows the policy's named insured.

  2. 2

Check limits against your excavation exhibit

Confirm commercial general liability of $1,000,000 each occurrence / $2,000,000 general aggregate, an umbrella of $10,000,000 that follows form over CGL, auto and employer's liability, and statutory workers compensation. Then confirm contractors pollution liability and railroad protective liability and cg 24 17 are evidenced, because they do not appear on a standard ACORD 25.

  3. 3

Read the endorsement pages, not the checkboxes

A Y in the ADDL INSD or SUBR WVD column is not an endorsement. Confirm CG 20 10, CG 20 37, CG 20 01, CG 24 04, WC 00 03 13, CA 20 48, CG 25 03 and CG 24 17 are attached as forms, and that the ongoing and completed operations forms share the same edition date.

  4. 4

Scan the schedule of forms for excavation exclusions

Look for explosion, collapse and underground (XCU) exclusion, subsidence or earth movement exclusion, total pollution exclusion and railroad exception in the insured contract definition. None of these appear on the certificate; they sit in the declarations schedule of forms and the endorsement pages.

  5. 5

Check carrier ratings and policy dates

Confirm each carrier is rated A- VII or better by AM Best and that no policy expires before the excavation scope and its completed operations period are finished. Set renewal reminders at 60, 30, 15 and 0 days.

  6. 6

Hold payment and site access until resolved

Keep the excavation sub's pay applications and jobsite badges on hold until every finding is resolved, then file the verified packet so it is ready if you ever need to tender a claim.

Deficient: 3 findings

  • XCU or underground exclusion attached

Utility strikes and collapse are excluded.

  • Contractors pollution liability

Contaminated soil and spoils hauling uninsured.

  • CG 24 17 for work within 50 feet of rail

    Railroad indemnity is uninsured.

Pikorua Security would send a deficiency notice to the sub and its broker citing each item, and hold payment until a corrected endorsement arrives.

Questions

Excavation & Sitework COI questions

What is an XCU exclusion on an excavation contractor's policy?
XCU stands for explosion, collapse and underground property damage. ISO removed these exclusions from the standard CGL in 1986, but many carriers still attach their own XCU endorsements for excavators. With one attached, damage from striking an underground utility or collapse of an adjacent structure caused by the excavation can be excluded.
When is CG 24 17 required for sitework?
When the work is on or within 50 feet of railroad property. The standard CGL insured contract definition does not cover contractual liability assumed for construction or demolition in that zone. CG 24 17 restores it for the scheduled railroad and job site, and railroads typically require it alongside a railroad protective liability policy.
Do excavation subs need pollution liability insurance?
On most commercial sitework, yes. Excavators disturb soil that may be contaminated, run diesel equipment all day and often haul spoils off site. Many CGL policies carry a total pollution exclusion, so a contractors pollution liability policy, ideally with transportation coverage, is the coverage that responds.
